In a substantial development the Supreme Court agreed that petitions to be considered in the National Eligibility-cum-entry-test (NEET) admission would challenge the Centre’s decision to establish a quota of 10% for the economically weaker category of section (EWS) and a quota of 27% for the other backward categories (OBC).
The SC said that the decision of Prime Minister Narendra Modi-lead government on the centre was contrary to the Higher Court of Madras order, in Arvind P. Datar, representing petitioner Neil Aurelio Nunes and others. SC said that. Datar added that the decision also raises questions as to whether a horizontal or vertical reservation should take place.
Advocate Vikas Singh, representing another petitioner Yash Tekwani and others, said the SC bench that in an earlier verdict it was ruled by the apex court that there will be no reservation in higher degree courses and the Centre’s decision will directly impact the NEET.
The petitioners urged the SC to quash the Medical Counselling Committee notice issued on July 29, which allows the implementation of reservation criteria in the current academic session.
The SC bench heard the arguments of the petitioners and issued notice to the Central government and the Medical Counselling Committee.
The plea said: “That the Petitioners have filed the present writ petition under Article 32 of the Constitution of India to bring to the notice of this Court the grave and serious problems faced by thousands of students across the country in view of notice dated July 29, issued by the Respondent No 1 (MCC).”
